Gender Harassment Prevention Committee

Objectives of the committee

To create awareness about sexual harassment and its prevention.

  • Providing protection to women against sexual harassment at the workplace& institution
  • To prevent sexual harassment
  • To provide a redressal mechanism for complaints relating to sexual harassment at the workplace.

Functions of the committee

  1. To publicize the policy against sexual harassment in English, Hindi and Kannada language.
    1. The committee endorsed the Hon’ble Supreme Judgement 1997 and 2012 and decided to publicize widely the policy against sexual harassment in various languages by displaying the appropriate documents on college, hospital and hostels (boys and girls) notice boards.
  2. All the HOD’s of various departments were informed regarding the Hon’ble Supreme Court guidelines with respect to prevention of sexual harassment at workplace.
  3. According to the Supreme court guideline Sexual harassment can be defined as “unwelcome” sexually determined behavior. (whether directly or by implication) as:
  • Physical contact and advances;
  • Demand or request for sexual favours;
  • Sexually coloured remarks;
  • Showing pornography; and
  •  Other unwelcome physical, verbal or non-verbal conduct of a sexual nature. (Vishaka judgment by Supreme Court)

The following is also sexual harassment and is covered by the committee:

  • Eve-teasing,
  • Unsavoury remarks,
  • Jokes causing or likely to cause awkwardness or embarrassment,
  • Innuendos and taunts,
  • Gender based insults or sexist remarks,
  • Unwelcome sexual overtone in any manner such as over telephone (obnoxious telephone calls) and the like,
  • Touching or brushing against any part of the body and the like,
  • Displaying pornographic or other offensive or derogatory pictures, cartoons, pamphlets or sayings,
  • Forcible physical touch or molestation and Physical confinement against one’s will and any other act likely to violate one’s privacy.

Penalties:

  1. Any member of the AIMS & AHRC & its Constituents, nonteaching staff, student, service provider, and resident found guilty of sexual harassment shall be liable for disciplinary action.
  2. The penalties listed below are indicative, and shall not constrain the AIMS & AHRC & its constituents’ authorities from considering others, in accordance with the rules governing the conduct of all members of the AIMS & AHRC.

A. In the case of academic/administrative/ technical/ nonteaching staff/ management, disciplinary action could be in the form of one or more of the following:

  • Warning
  • Written apology
  • Bond of good behavior
  • Gender sensitization
  • Counseling
  • Adverse remarks in the Confidential Report
  • Debarring from supervisory duties
  • Denial of membership of statutory bodies
  • Denial of re-employment
  • Stopping of increments/promotion
  • Reverting, demotion
  • Transfer
  • Dismissal
  • Withdrawal of residential facilities and prohibition from entry on the campus etc.
  • Any other relevant mechanism.

B. In case of students, disciplinary action could be in the form of:

  • Warning
  • Written apology
  • Bond of good behavior
  • Gender sensitization
  • Counseling
  • Debarring entry into a hostel/ campus
  • Withholding results
  • Debarring from exams
  • Debarring from contesting elections
  • Debarring from holding posts
  • Expulsion
  • Denial of admission
  • Declaring the harasser as “persona non grata” for a stipulated period of time
  • Any other relevant mechanism.
  • (NOTE: The reasons for the action have to be provided in writing. Action will be taken against person(s) who try to pressurize the complainant in any way).
